This Website is powered by GlossGenius, Inc. (“GlossGenius” or “We”). The following Website Terms and Conditions of Use (“Terms”) govern your access to and use of this Website, including any functionality and services offered on or through this Website. By accessing or using this Website in any manner, you accept and agree to be bound by these Terms.

1. WHAT WE DO (AND DON’T DO)

GlossGenius is a software platform for beauty and wellness businesses (“GlossGenius Users”) that helps streamline their operations and improve their clients’ experiences. For example, GlossGenius provides:

  • a custom website builder for GlossGenius Users (like this one);
  • functionality for booking and managing appointments between GlossGenius Users and their clients;
  • marketing tools for GlossGenius Users to communicate with their clients and advertise their services; and
  • payment management through the use of third-party vendors, such as Stripe Connect, Tap to Pay on iPhone, and Stripe Terminal SDK. 

We do not review the contents of GlossGenius Users’ websites or their marketing communications. We expect all GlossGenius Users to comply with our binding Terms of Service and Acceptable Use Policy and all applicable laws and regulations in the U.S. state or territory in which they are operating. ‍

2. WHO CAN USE

You may only access or use this Website if you agree to these Terms and are at least eighteen (18) years old in the United States or at the minimum age of consent to transact in your country, if not located in the United States. 

3. INTELLECTUAL PROPERTY RIGHTS

The content posted on this Website by the GlossGenius User about the GlossGenius User’s services (“User Content”), including images and descriptions, does not belong to GlossGenius, though GlossGenius Users grant GlossGenius a license to the User Content, as per the GlossGenius Terms of Service. GlossGenius makes no representations or warranties regarding the User Content. Without limiting any of its remedies available under law, GlossGenius will process and investigate proper notices of alleged copyright or other intellectual property infringement related to the User Content, and will respond, appropriately, following the guidelines of the Online Copyright Infringement Liability Limitation Act and other applicable intellectual property laws. 

All other information, text, graphics, images, photographs, logos, trademarks, service marks, the Website’s code and software or tools designed and used, and material (collectively “GlossGenius Content”) is owned by GlossGenius, its licensors, or other providers of such material and is protected under both United States and foreign copyright laws, as well as trademark law, trade dress, patent, and other intellectual property rights and unfair competition laws. All rights are reserved.

This Website, User Content, and any GlossGenius Content are only for your personal and non-commercial use. 

4. EVENT TRACKING THROUGH THE USE OF PIXELS

As part of GlossGenius’ custom website builder, we may give GlossGenius Users the option to add pixels, which track the activity of visitors to their websites. The purpose of these pixels is to help GlossGenius Users understand and evaluate the performance of their Google and Meta (Facebook and Instagram) paid ads. 

Therefore, please be advised that this Website may contain Google Analytics and Meta Pixels. These pixels are created and managed through the GlossGenius User’s respective Google Analytics and Meta Business Suite accounts. For questions or more information, please contact your GlossGenius User (salon or professional) directly.

5. HARDWARE, SOFTWARE, AND ACCESS

You are responsible for obtaining your own hardware, software, and related services, such as computers, phones and internet access services, and browsers to access the Website. You agree to take appropriate precautions, such as the use of anti-virus software, to protect your computer hardware and software.

GlossGenius may not be held responsible for any loss or damage suffered (directly or indirectly) by making use of GlossGenius Content. Nor can we guarantee that pages will display correctly in all web browsers, accessibility applications, or that the Website will be online at all times.

GlossGenius is not responsible for the unavailability of the Website whether due to problems of Internet access or otherwise. GlossGenius also may not be held responsible for any defect, malfunction, or interruption in service or security due to any hardware or software you use, or due to your Internet service provider.

6. THIRD-PARTY APPLICATIONS AND SERVICES

GlossGenius utilizes certain third-party applications and services to power certain portions of the websites created using GlossGenius’ website builder and the services provided therein. GlossGenius disclaims any and all liability arising from the use of third-party software or the content furnished by any third-party software producer, including but not limited to, any resulting information obtained from such use, or interpretations of information from such use. 

Your use of this Website is conditioned upon your and the GlossGenius User’s acceptance and compliance with the terms and conditions applicable to such third-party applications and services, including without limitation:

  • EasyTeam to allow you to use time tracking and other employee management functionality within the GlossGenius Service. You must comply with their Terms.

GlossGenius does not sponsor or endorse any third-party applications and services and has no obligation to support or maintain such third-party applications and services, and further GlossGenius expressly disclaims any representations and warranties, with respect to such third-party applications and services. GlossGenius does not monitor such third-party applications and services, nor does it have any control or input. We shall have no liability whatsoever arising from or relating to your use of third-party applications and services.

7. GENERATED OUTPUT

(a) Certain features of the Services use artificial intelligence tools and other technology (the “Generative Tools”) to generate text, audio, video, and other content (“Outputs”) in response to prompts and other inputs you submit to the Services (“Inputs”). Both Inputs and Outputs are considered User Content under these Terms of Service, and as between you and GlossGenius, you own all right, title, and interest in and to any Inputs and Outputs, to the extent protectable under applicable law. The Generative Tools may include artificial intelligence and other tools and technologies provided by third parties, and you acknowledge that your use of the Generative Tools may involve access to your Inputs and Outputs by GlossGenius and/or such third parties, and that such access may be pursuant to agreements you enter into with those third parties, rather than or in addition to these Terms of Service. You understand that due to the nature of the Generative Tools, Outputs you generate may not be unique, and it is possible that the Generative Tools may generate the same or similar Outputs for other users if the Inputs are similar. You acknowledge that the use of such Generative Tools may affect your ability to obtain or enforce any intellectual property rights in or to the Outputs.

(b) Although we are constantly striving to improve the Services and the quality and accuracy of Outputs, you acknowledge that artificial intelligence and machine learning technologies are rapidly evolving and may produce Outputs that are inaccurate, unreliable, inappropriate, infringing, or otherwise unsuitable or that do not meet your expectations.

(c) You agree not to use the Generative Tools or the resulting Outputs in a manner that may infringe upon or violate the rights of any third party or violate any applicable laws, rules, or regulations, and you acknowledge and agree that (1) you are solely responsible for vetting and evaluating the accuracy, appropriateness, legality, and suitability for your use of any Outputs before using, including evaluating whether such use will infringe upon or violate the rights of others; and (2) you assume all risk associated with your use of the Generative Tools and its resulting Outputs and that GlossGenius will have no liability for such use.

(d) You also acknowledge and agree that we and any third parties who provide any artificial intelligence technologies used to provide the Generative Tools may access and use your Inputs, Outputs and other User Content in order to train, improve, and develop such technologies and the Services and for other research and development purposes.

8. INFORMATION ON WEBSITE AND DISCLAIMER OF WARRANTIES

GlossGenius makes no representation, whether express, implied in law or residual, as to the sequence, accuracy, completeness, or reliability of the information contained on the Website. We do not accept responsibility for any errors or omissions in the User Content, GlossGenius Content, or anything in the website.

GlossGenius reserves the right to change or discontinue any aspect or feature of this Website.

YOU AGREE THAT YOU ARE MAKING USE OF OUR SERVICES AT YOUR OWN RISK, AND THAT THEY ARE BEING PROVIDED TO YOU ON AN "AS IS" AND "AS AVAILABLE" BASIS. (INCLUDING OUR OWNERS, INVESTORS, EMPLOYEES, OR AGENTS) BE LIABLE TO YOU OR ANY THIRD PARTY UNDER ANY CLAIM AT LAW OR IN EQUITY FOR ANY CONSEQUENTIAL DAMAGES OR LOSSES (INCLUDING, BUT NOT LIMITED TO, LOSS OF MONEY, GOODWILL OR REPUTATION, PROFITS, OTHER INTANGIBLE LOSSES, OR ANY SPECIAL, INDIRECT, OR CONSEQUENTIAL DAMAGES), AND ALL SUCH DAMAGES OR LOSSES ARE EXPRESSLY EXCLUDED BY THIS USER AGREEMENT WHETHER OR NOT THEY WERE FORESEEABLE OR GLOSSGENIUS, INc. WAS ADVISED OF SUCH DAMAGES OR LOSSES.
