This Privacy Policy describes how Ask Locala Inc (“Locala,” “we,” or “us”) collect, use, disclose, and otherwise process information through our location-based digital advertising and analytics platform. This Privacy Policy applies to our U.S. operations only. It also covers only information collected through our advertising platform where we act as a data controller and not where we act as a data processor on behalf of our clients. ABOUT US
Locala provides a location-based digital platform designed for use by advertisers such as retail chains, restaurants, and car dealerships, which are clients of ours. Our platform enables our clients to evaluate their store performance, identify new potential customers, show ads to existing and potential customers, and to measure the effectiveness of their advertisements. In providing this platform, we sometimes act as a data processor to our clients (in which case, this privacy policy does not apply). In other cases, such as when we help clients to target ads to their customers, we act as a controller, in which case this policy does apply.
COLLECTION OF INFORMATION
We may collect information about you through our partners that license data to us or directly, such as when you visit a website or mobile app that calls our servers to show an ad. This information includes:
- Device Identifiers and Activity Information: This includes identifiers assigned to your device and network, such as IP address and mobile advertising identifiers, together with information about the ads or content you view or click on websites or in mobile apps and when the activity took place.
- Precise Geolocation Information: We may receive from our partners information about the latitude and longitude of your device, in accordance with location permissions you have granted on your device to such partners. We associate such precise geolocation data with specific areas and locations to deduce the presence of a device within these areas or locations at a specific time.
- Information from Other Sources: We obtain information from other services, including data brokers. This information may include information about your precise geolocation and online activity.
- Information We Derive: We may derive information or draw inferences about you based on the information we collect. For example, we may make inferences about visits to a particular type of store to infer that you’re interested in a particular type of business.
USE OF INFORMATION
We use the information we collect to deliver personalized advertising, including to assist our clients in showing ads to people who have visited their establishments or that the client thinks may be likely to visit their establishment, and to measure the performance of ads, including through the use of precise geolocation information. We also use the information we collect to:
- Monitor and analyze trends, usage, and activities in connection with our products and services;
- Detect, investigate, respond to, prosecute, and help protect against security incidents and other
malicious, deceptive, fraudulent, or illegal activity, and help protect the rights and property of
Locala and others and others; - Improve our products and services and develop new offerings; and
- Comply with our legal and financial obligations.
TARGETED ADVERTISING
We use the information we collect to help our clients deliver advertising targeted to you, a practice that is known as “targeted advertising” under some laws. You can opt out of our use of information to show ads that are targeted to your interests by visiting the Your Privacy Choices link in the site footer.

DISCLOSURE OF INFORMATION
We disclose the personal information we collect in the following scenarios:
- Vendors and Service Providers. We make personal information available to our vendors, service providers, contractors and consultants who perform services on our behalf, such as companies that assist us with running our business.
- Law Enforcement Authorities and Individuals Involved in Legal Proceedings. We disclose personal information in response to a request for information if we believe that disclosure is in accordance with, or required by, any applicable law, regulation, or legal process, including lawful requests by public authorities to meet national security or law enforcement requirements.

We may disclose personal information if we believe that your actions are inconsistent with our user agreements or policies, if we believe that you have violated the law, or if we believe it is necessary to protect the rights, property, and safety of Locala, the public, or others.
- Professional Advisors. We disclose personal information to our legal, financial, insurance, and other professional advisors where necessary to obtain advice or otherwise protect and manage our business interests.
- Corporate Transactions. We disclose personal information in connection with, or during negotiations of, certain corporate transactions, including a merger, sale of company assets, financing, or acquisition of all or a portion of our business by another company.
- Corporate Affiliates. Personal information is disclosed between and among Locala and our parents, affiliates, subsidiaries, and other companies under common control and ownership.
- With Your Consent or at Your Direction. We make personal information available to third parties when we have your consent or you intentionally direct us to do so.
We also disclose aggregated or de-identified information that cannot reasonably be used to identify you. We maintain and use this information only in a de-identified fashion and will not attempt to re-identify such information, except as permitted by law
DATA RETENTION
We store precise location information for four months unless we need to retain it longer, such as to meet a legal obligation.
YOUR CHOICES
Precise Geolocation Information
When use certain mobile apps, they may ask permission to collect precise geolocation information. If you provide such consent, your location information may be shared with us by the mobile app developer or another partner. If you initially consent to the collection of precise geolocation information, you can subsequently stop the collection of this information at any time by changing the preferences on your mobile device. Locala and our clients and partners may use cookies and similar tracking technologies. You can usually adjust your browser settings to remove or reject browser cookies.

Individuals Residing in Certain U.S. States
Some U.S. states have enacted privacy laws that grant their residents certain rights and require specific disclosures (“State Privacy Laws”). Your Rights under State Privacy Laws
Opt Out of Sales, Sharing, and Targeted Advertising
Our platform helps our clients improve ad targeting across many sites and apps, and some of the activities set out in this policy and in the table above, such as personalizing ads, may involve Locala processing personal data for purposes of “targeted advertising,” [or engaging in “sales” or “sharing” of personal information] under certain State Privacy Laws. You may opt out of Locala’s use of your information for these activities, including our use of any precise geolocation information for such purposes (known in California as the “right to limit”), by following the prompts behind the Your Privacy Choices link in the footer of our website.
Access, Correction, and Deletion
You may have the right to (1) request to know more about and access your personal information, including in a portable format, (2) request deletion of your personal information, and (3) request correction of inaccurate personal information. You can exercise these rights at any time or ask any other questions about the processing of your personal information by sending an email to privacy@asklocala.com or call our toll-free number at (800) 607-7838. To authenticate your request, we may ask you to provide proof that the device for which you are requesting to exercise your rights belongs to you. If your request concerns processing by our clients, they are solely legally responsible for responding to you, and we will forward your request to them.
Nondiscrimination
We will not discriminate against for exercising any of your privacy rights.
Appeals
If we deny your request, you may appeal our decision by contacting us at privacy@asklocala.com. If you have concerns about the result of an appeal, you may contact the attorney general in the state where you reside.
Authorized Agents
If you are an authorized agent seeking to make a request to opt out of sales, sharing, or targeted advertising on behalf of a consumer, you may contact us at privacy@asklocala.com.
If you reside in California, you may also designate an authorized agent to submit an access, deletion, or correction request on your behalf. We may ask authorized agents to submit proof of their authority to make a request, such as a valid power of attorney or proof that they have signed permission from the consumer who is the subject of the request. In some cases, we may contact the individual who is the subject of the request to verify their own identity or confirm the authorized agent has permission to submit the request.
