Meta paid $𝟭.𝟯 𝗯𝗶𝗹𝗹𝗶𝗼𝗻 for privacy violations Amazon faced a $𝟳𝟴𝟭 𝗺𝗶𝗹𝗹𝗶𝗼𝗻 fine Facebook paid $𝟮𝟳𝟱 𝗺𝗶𝗹𝗹𝗶𝗼𝗻 Google? $𝟭𝟲𝟵 𝗺𝗶𝗹𝗹𝗶𝗼𝗻 settlement All for crossing the privacy line. Your Startup can loose everything because: → Users found out their data was oversold → Trust was broken by hidden tracking → Personalization went too far As a product designer and business owner, here's where I draw the line: The Privacy-First Framework I use: → Give users control to opt out easily → Only collect what you'll actually use → Make data collection obvious, not hidden → Delete data when you don't need it anymore Ask yourself: "Would I be comfortable explaining our data practices to my users face-to-face?" If the answer is no, you've crossed the line. Quick ethical guidelines: → Show users what you know about them → Be transparent about data sharing → Let them delete their data easily → Make 'Off' the default setting Because here's the truth: Users will forgive a bad design But they never forget a privacy breach Whether you're a designer or business owner/decision maker, you should have this talk with other stakeholders. 6 websites, 1 audit: Every pixel exposed sensitive data 𝐖𝐡𝐚𝐭 𝐡𝐚𝐩𝐩𝐞𝐧𝐞𝐝: This week, a Nordic privacy regulator inspected six mainstream B2C websites - health, pharmacy, faith, and public services. 𝐑𝐞𝐬𝐮𝐥𝐭: Every single one shared user data with third parties, unlawfully. 𝐖𝐡𝐚𝐭 𝐦𝐚𝐝𝐞 𝐭𝐡𝐢𝐬 𝐚𝐧 𝐢𝐦𝐦𝐞𝐝𝐢𝐚𝐭𝐞 𝐢𝐧𝐝𝐮𝐬𝐭𝐫𝐲 𝐢𝐬𝐬𝐮𝐞? 1) Personal data - sometimes sensitive - was leaked via tracking pixels. 2) Children’s data and health/religious info were shared without consent or legal basis. 3) Most site owners had no idea pixels were transmitting this data. 4) One site, supporting vulnerable kids, was fined NOK 250,000. 5) Five others got formal reprimands—this time. 𝐓𝐞𝐜𝐡𝐧𝐢𝐜𝐚𝐥 𝐃𝐞𝐩𝐭𝐡: 𝐖𝐡𝐚𝐭 𝐩𝐢𝐱𝐞𝐥𝐬 𝐫𝐞𝐚𝐥𝐥𝐲 𝐞𝐱𝐩𝐨𝐬𝐞𝐝 - Browsing history + metadata = easy inference of health, religion, or children’s issues. - Pixels triggered data flows to big tech (often cross-border). - Sites claimed “anonymity” but logged full digital footprints. - Consent flows were misleading or nudging, not valid. 𝐖𝐡𝐲 𝐝𝐨𝐞𝐬 𝐭𝐡𝐢𝐬 𝐤𝐞𝐞𝐩 𝐡𝐚𝐩𝐩𝐞𝐧𝐢𝐧𝐠? a) Many enterprises lack pixel visibility - can’t track what data leaves, or where. b) Dev and marketing teams install pixels to optimize UX or ads - privacy impact rarely assessed. c) Legal & compliance teams discover violations only after audits or enforcement. 𝐖𝐡𝐚𝐭 𝐠𝐥𝐨𝐛𝐚𝐥 𝐁2𝐂 𝐭𝐞𝐜𝐡 𝐚𝐧𝐝 𝐩𝐫𝐢𝐯𝐚𝐜𝐲 𝐥𝐞𝐚𝐝𝐞𝐫𝐬 𝐬𝐡𝐨𝐮𝐥𝐝 𝐝𝐨 𝐍𝐎𝐖: - Audit all pixels and third-party scripts - quarterly at minimum. - Map real data flows - not just what’s “documented.” - Validate consent flows: Are users truly informed and free to say no? - Flag any special category data exposure (health, religion, minors). 𝐌𝐲 𝐏𝐎𝐕: You can’t manage what you don’t measure. A single pixel, if left unchecked, can trigger regulatory risk at enterprise scale. 𝐖𝐚𝐧𝐭 𝐲𝐨𝐮𝐫 𝐭𝐞𝐚𝐦 𝐭𝐨 𝐬𝐩𝐨𝐭 𝐭𝐡𝐞𝐬𝐞 𝐛𝐥𝐢𝐧𝐝 𝐬𝐩𝐨𝐭𝐬 𝐞𝐚𝐫𝐥𝐲? 🔐 Designing For Privacy UX. Privacy isn’t about hiding something, but protecting user’s personal space. UX guidelines on how to design more respectful, private experiences that drive long-term loyalty ↓ 🤔 When data requests feel intrusive, users enter fake data or give in. ✅ Privacy is about user’s control of what happens to their data. ✅ Privacy by default: features should work with min data required. 🚫 Don’t ask for permissions that you don’t need at the moment. ✅ Right to be forgotten → allow users to delete data in settings. ✅ Data portability → allow users to take their data with them. ✅ Hidden Unsub links downgrade email reach (marked as spam). ✅ Neutral choices → give people real choices with neutral defaults. ✅ Data you don't ask for is the data you can't lose in a breach. ✅ Explain then ask → if you need user’s data, first explain why. ✅ Try before commit → show and explain value before asking for data. ✅ Remind me later → give people time to make a decision on their terms. ✅ Contextual consent → ask for data only when user’s action needs it. ✅ Automated data decay → delete user's data not used after X months. --- In many companies, privacy is treated as a technical hurdle to be cleared off. Companies thrive on user’s data for personalization, customized offers, better AI models — but also invasive targeting, ultra-precise tracking, behavioral predictions and eventually reselling data to the highest bidder. All of it isn’t only invasive and undermines trust — it also makes for slow experiences and advertising following you everywhere you go. Predictive models know a person is pregnant based on their browsing habits before they do. And once they do, ads, offers and messages will follow you everywhere you go — before your closest relatives hear it from you. When we speak about privacy, we often assume that that’s an exaggerated problem that doesn’t really affect us much. After all, we have nothing to hide, and so there is no harm in companies knowing a few things about us. But privacy isn’t about hiding something. It’s about protecting your personal space from external influence and manipulation. It’s about protecting your personal decisions and your intimate experiences, and having a choice to share them with people you trust and care of. Most people wouldn’t feel comfortable being observed by a camera during their work or during their spare time. Yet as we move from one page to the next, that’s exactly what happens, often without our consent. And just like web performance and accessibility, privacy is a part of user's experience. The good news is that European Commission is looking into modifying the way GDPR works. So users could tick a box in browser preferences, with privacy settings turned on by default. And then websites shouldn't be allowed to ask for consent because it's already not granted. I'm looking forward to that future. Years later, I realize it’s actually a huge advantage! ⚡️My legal background gives me a unique perspective on UX design, especially in areas like user privacy and data protection. Here’s how I apply that experience in my design work: 📍1. Building Trust with Privacy-First Designs: People want to feel safe when they’re online. My legal experience helps me design interfaces where users can clearly see how their data is being used and controlled. For instance, I add clear and accessible privacy settings so that users always know where to adjust their preferences 📍2. Designing Simple and Clear Consent Flows: Those pop-ups asking for permission to use cookies or personal information are common, but they’re often confusing. With my legal background, I make sure these consent screens are easy to understand, using plain language and straightforward options, so users know exactly what they’re agreeing to. 📍3. Anticipating Privacy Risks in User Flows: Knowing the rules around data privacy allows me to spot potential issues before they become problems. For example, when designing a form, I think carefully about each field, asking only for what’s necessary and showing users why we need it. This minimizes risks and makes users feel secure. 📍4. Creating Ethical, User-Centric Experiences: Law taught me the importance of respecting people’s rights, which I bring directly into my design. I make sure every interaction, from signing up to sharing data, is respectful of user privacy. For example, I often include ‘learn more’ options or tooltips that explain how their data will be used—giving users control and confidence. 🌹I hope you can see that no knowledge or skill is ever a waste—and it becomes even more valuable when you understand how to apply it. Vietnam’s final PDPL implementing decree has now been officially published (PDF attached to this post). If you run websites, eCommerce, or manage marketing stacks for clients: this is your “last mile” moment. The decree is very clear that online behavioral/usage tracking data can fall under sensitive personal data - meaning consent-before-tracking and tight vendor control is no longer optional - and the rules kick in today! A practical web-facing action plan (agency-friendly) - Scan every site (today). Identify what loads before consent: pixels, beacons, GTM & tags, session replay, fingerprinting, chat widgets, embedded maps/video, CDPs, ad platforms. - Stop pre-consent collection & sharing. Block all non-essential scripts and third-party calls until valid opt-in. - Fix consent UX + proof. Clear purposes, granular choices, equal “Accept/Reject”, easy withdraw, store consent logs (who/what/when). - Vendor governance. Create a “tag allowlist,” remove unknown vendors, document data flows, align contracts/DPAs and data transfer impact assessments. - Marketing stack hardening. Re-check server-side tracking, “consent mode” configs, CRM forms, lead enrichment, email tools, and cross-domain tracking. - Repeat weekly. Sites are continuously updated. 🛍️ I Know What You Bought Last Summer: Unveiling Privacy Risks in E-Commerce 🧐 With all the hype on AI and its challenges we should not forget to look where data for misuse comes from ⚡A recent study titled “I Know What You Bought Last Summer” reveals alarming insights into how these platforms handle user data, raising significant concerns about privacy and cybersecurity 🔍 Key Findings: 👉 Incentivised Data Disclosure: Platforms routinely nudge users to reveal names, emails, preferences, and shopping history in exchange for minor benefits. 👉 Third-Party Data Access: Many e-commerce sites integrate third-party tools (e.g. analytics, advertising, social media) that quietly siphon off user data. 👉 Profiling Through Minimal Activity: Even a single visit or click can result in aggregated tracking — creating detailed behavioural profiles across platforms. 🎯 What this means for AI and cybersecurity: As AI is increasingly used to analyse and act on this data, the risk of misuse multiplies: 📍 AI systems can turn raw data into detailed, predictive user models, which can be exploited for manipulation, surveillance, fraud or worse. 📍Companies using this data often underestimate the compliance and ethical risks, particularly as regulations tighten. ✅ Bottom line? 🌟 Under the EU’s cybersecurity and data protection frameworks (including the NIS2 Directive and GDPR), e-commerce operators are required to secure personal data and limit unauthorised access, even from their own partners. 🌟 They need to strengthen internal controls and audit third-party integrations to meet legal obligations. 🌟 That will need adequate policing as well 🤓 But that alone will not solve the problem 👉 we need better user eduction on the all the privacy and cybersecurity challenges in daily life 👉 Like the request for more AI literacy we also urgently need more cybersecurity literacy 👉 especially as AI tools amplify the potential for abuse. 🤓 Helping users stay alert to how their data is collected, combined, and exploited and how to protect against that should be part of responsible digital governance. 🔗 to the paper in the comments #artificialintelligence #security #innovation #governance #education

The Central Consumer Protection Authority’s advisory dated June 5, 2025, calls upon all e-commerce platforms to conduct self-audits to identify and eliminate dark patterns. Points 4 and 5 of the advisory specifically underscore the importance of obtaining explicit, informed user consent and institutionalizing regular self-audits to ensure compliance with fair trade practices. These requirements align closely with the Digital Personal Data Protection Act, 2023, particularly Section 6, which mandates that consent for data processing must be free, specific, informed, and unambiguous, and Section 10, which emphasizes the necessity of data audits and impact assessments to enhance organizational accountability. In an era where digital interactions shape consumer experiences, embedding principles of transparency, consent, and auditability into platform design may help both in legal compliance and the preservation of user trust.
